Your continued use of the Website and/or the Services will be construed as your consent to the amended or updated Terms, and will be conditional upon the Terms in force at the time of your use. You must not use this Website if you do not agree to the Terms and Conditions.
2.1. These Terms and Conditions apply to users who are consumers for purposes of the Consumer Protection Act, 68 of 2008 (the “CPA”).
2.2. If there is any provision in these Terms and Conditions that you do not understand, it is your responsibility to ask I-Go-Print to explain it to you before you accept the Terms and Conditions or continue using the Website.
2.3. Nothing in these Terms and Conditions is intended or must be understood to unlawfully restrict, limit or avoid any right or obligation, as the case may be, created for either you or I-Go-Print in terms of the CPA.
3.1. The Website provides web-to-print services (collectively referred to as the “Services”), including customised printing of documents in various formats and on various materials (the "Products") with delivery solely within the territory of South Africa. Unless specified otherwise, these Conditions apply to all Services offered by I-Go-Print, where compatible. The provision of Services may be entrusted by I-Go-Print to third-party subcontractors or sub suppliers.
3.2. All final product prices displayed on the Website are given in Rands and are inclusive of any applicable Value Added Tax (“VAT”),. The prices of the Services are subject to periodic changes and variations. If an error is made and a product is listed at an incorrect price, I-Go-Print shall maintain the right to refund or cancel orders placed at the incorrect price.
3.3. All Service Fees shall be affected via electronic funds transfer or the payment gateway infrastructure on the I-Go-Print Website, provided via an independent third-party payment service provider, currently, PayGate. Users are encouraged to consult the PayGate website located at www.paygate.co.za to familiarise themselves with the security protocols and other policies in place and which may apply to any transaction conducted through PayGate.
3.4. Only Service Fee payments made via PayGate or electronic funds transfer shall be processed. Service Fee payments made via PayGate in a currency other than South African Rand (“Rand”), if accepted by PayGate, shall be converted into Rand at I-Go-Print’s financial institution’s then-current market rate of exchange. Payments made by electronic funds transfer will only be processed and accepted if made in South African Rands.
3.5. Service Fee payments made from Users located outside of the Republic of South Africa and/or in a currency other than Rand, shall be processed in accordance with PayGate’s policies and procedures, as amended from time to time.
4.1. The information and details given on the Website should not be considered as offers: they are simply an invitation to Users to do business by sending purchase orders. The proposal to purchase Products is formulated by the User at the moment the order form is sent in electronic format at the end of the procedure provided by the Website and described below.
4.2. After being authenticated, the User will be able to proceed with the selection of Products as described in the appropriate sections, by selecting them individually, customising them, and adding the required quantity to the shopping basket. Some images may be provided for information purposes only and may differ from the appearance of the delivered Product.
4.3. Unless the User opts for images or designs suggested by I-Go-Print for certain Products, once the order has been confirmed and the payment has been completed (with the exception of cash on delivery and bank transfer payment options), the User will be asked to complete the order by uploading the file/artwork they wish to print in the “Upload Area”.
4.4. The user remains solely responsible for verifying the content, spelling and artwork of the uploaded files.
4.5. After selecting the desired items, an order checkout screen will be displayed showing the costs and total order value for all the Products and/or Services selected.
4.6. Once the order has been sent, the User will receive an order confirmation that describes the type of Products ordered, the price of each Product, the corresponding taxes, the shipping costs and the payment method chosen. The contract is considered concluded and binding when I-Go-Print sends the order confirmation to the User at the email address s/he provided when registering on the Website.
4.7. I-Go-Print reserves the right, at its sole discretion, to refuse any order. The reasons for this may include (without limitation):
the information provided by the User when filling in the order form being incomplete or incorrect;
the User not meeting the requirements for the terms of payment;
the Products ordered not being available.
the nature of content being offensive, sexually explicit, pornographic or racially discriminating
In the examples listed above, I-Go-Print will inform the User by email that the order proposal was not accepted (in full or in part), specifying the reasons for the non-acceptance, and that the contract was not therefore concluded. In this case, I-Go-Print will reimburse to the User any sums the User has already paid.
5.1. Payments must be made in advance, and only once the payment has been made and a "print-ready" file has been uploaded by the User will the selected items will be sent for production.
5.2. For payments via bank transfer, production will begin only after payment is received, and as a result, delivery may be delayed by 2-3 days, in addition to the time needed for printing and shipping the items. For this payment method, the order number must be entered in the payment reference section so the transaction can be identified.
6.1. The selection of content and images to be printed, as well the obtaining of authorisation for their reproduction, where necessary, is the sole responsibility of Users. I-Go-Print will not under any circumstances check content, apart from aspects related to the technical specifications and the artwork’s compatibility with the required specifications.
6.2. I-Go-Print cannot in any way be held liable for the unauthorised use of images/artwork by Users or for any breach of third-party rights relating to them. The User therefore releases, indemnifies and holds harmless I-Go-Print from any liability towards third parties for breach of intellectual property rights, damage to image, honour, decorum, moral integrity or any monetary or non-monetary damage resulting from the printing of images and content uploaded by the user.
6.3. User Submissions do not contain any viruses, worms, spyware, adware, or other potentially damaging programs or files;
6.4. We are not responsible for any loss, theft, or damage of any kind to any User Submissions.
6.5. I-Go-Print reserves the right, at any time, to stop any order which clearly breaches the intellectual property rights of third parties or which is defamatory, violent or otherwise contrary to public law and decency.
7.1. I-Go-Print's system automatically checks compatibility with regards to the format, dimensions, resolution and the presence of non-embedded fonts, checks the fonts and their conversion into paths, checks for any white overprinting or knockout, and converts Pantone colours to the best profile for the print requested (the system does not indicate Pantone colours present in the file, but converts them directly to CYMK).
7.2. If the file is not compliant, the system will block the order. In this case, the User will be advised immediately via email and asked to upload a new file, with a resulting delay in the delivery date.
If the system does not reveal any problems, the file will automatically be sent for production.
At the request of the User, for an additional fee, by selecting the “File Check” option the graphical and aesthetic aspects of the file can be checked by I-Go-Print. If Users select this option, I-Go-Print will proceed to check: the division of the artwork into layers, cut-to-shape paths, safety margins, the distance of the graphic elements from the edge of the print, front and back orientation, whether the .pdf file matches the specific requirements for magazines and/or catalogues (spine width, number of pages and cover files), and whether the graphic settings are correct if the print requires folding.
Please note that the professional file check does not include an exhaustive layout check, spell check or checking for any photos missing inside magazines, catalogues or books. You are still 100% responsible for the accuracy of your print-ready artwork files, and we encourage you to proofread all files carefully before submitting to us. We are not responsible for any issues as to orientation or alignment of the pages of your submitted artwork.
We may, based on our sole discretion, set limits to the maximum number of days that we shall retain designs or other uploaded files, as well as the maximum storage space that we would allocate to such files. We are not responsible for the deletion or failure to store any file whether uploaded or designed on our Website. We reserve the right to delete any file stored which has been inactive for an extended period of time, or for any other reason, without prior notice.
If requested, an online proof will be available for your review after we have received your files for print. Jobs with proof requests will not be sent to press without your approval unless the proof approval is explicitly waived. It is your responsibility to log in to your account and check on your proof. We are not liable for delays in the order caused by your non-approval of the proof.
An online proof is not an accurate colour reproduction of the final printed piece. It is the final opportunity for you to check the layout, bleeds, crops and final text. Electronic proofs do not show transparency and overprint issues. Nor do they show colour change from RGB to CMYK.
The proof must be treated as independent from the original submitted file and thoroughly reviewed prior to approval. It should be checked against the original file for possible errors in layout, copy, spacing, punctuation or image placement. You are fully responsible for all that is contained in the final approved proof.
Delivered plotter proofs show reasonable likeness to the final printed pieces. Such proofs are recommended for colour-critical art and must be requested by you when the print order is made. Delivered plotter proofs are printed on a substrate different from the actual paper stock and the plotter machine is not used for the actual printing of the job. Its main purpose is to show colour, variations may occur depending on the finish selected for the final print job.
The request for a Delivered plotter proof involves an additional fee and would extend the amount of time needed to complete the job. For orders where a Delivered plotter proof has been requested, the approval must be received by us on or before our published cut-off times. We will make every effort to match colours in production when a hard copy proof is requested. However, it is your responsibility to determine if they need a hard copy proof with their print order.
10.1. The Services are only available for delivery within the territory of South Africa; the Services therefore cannot be used for deliveries outside this territory.
10.2. As the sales process also involves shipping, the delivery times provide an indication only and are not guaranteed since, regardless of the payment made by the User, they depend on the delivery performance of third parties, such as couriers, and are calculated from the completion of the order, in other words, once the file has been uploaded and the confirmation message has been received.
10.3. The order will not be considered complete until the moment the file has been uploaded by the User and the corresponding payment has been made. If the User does not upload the file within 15 days of the order date, the order will be cancelled. In the event of a non-compliant file, the order will be cancelled if the file is not replaced within 15 days.
10.4. Delivery dates are subject to change if there are any errors with the artwork provided or an order is put on hold.
10.5. Under no circumstance will I-Go-Print be held liable for any damages caused by a late delivery, which is carried out by couriers that are third parties external to I-Go-Print.
10.6. Risks relating to Products are passed to the User at the moment the Products are handed over to the courier.
